This course examines the legal principles of the laws of wills and trusts, organization and jurisdiction of the California Probate Courts, estate planning and estate taxes.
(54 hours lecture;      Degree appropriate, CSU)

Course Measurable Objectives:

  1. Distinguish between types of wills and specify unique features of each.
  2. Describe various problems with wills, especially competency, capacity, fraud, and undue influence.
  3. Explain witnessing of wills.
  4. Assess the legal standing of holographic wills and codicils and identify ways to resolve problems in this area.
  5. Describe concepts of integration, incorporation by reference and revocation.
  6. Evaluate from the standpoint of estate planning general rules of inheritance, intestate succession and gifts.
  7. Identify types of trusts and significant features of each.
  8. State characteristics of the relationship between trustees and beneficiaries and propose potential problems which the legal specialist may need to resolve.
  9. Define the role of the legal specialist in the termination of trusts.
  10. Evaluate the effectiveness of various methods used in real estate planning as means to avoid probate.
  11. Design plans to minimize estate taxes.
  12. Analyze aspects of probate administration.

Course Level Student Learning Outcomes:

  1. Students completing PLGL 43 - Wills and Trusts will have agained an understanding of probate administration.
  2. Students completing PLGL 43 - Wills and Trusts will be able to distinguish between wills and trusts.
