This course examines the legal principles of the laws of wills and trusts, organization and
jurisdiction of the California Probate Courts, estate planning and estate taxes.

Course Measurable Objectives:
- Distinguish between types of wills and specify unique features of each.
- Describe various problems with wills, especially competency, capacity, fraud, and undue influence.
- Explain witnessing of wills.
- Assess the legal standing of holographic wills and codicils and identify ways to resolve problems in this area.
- Describe concepts of integration, incorporation by reference and revocation.
- Evaluate from the standpoint of estate planning general rules of inheritance, intestate succession and gifts.
- Identify types of trusts and significant features of each.
- State characteristics of the relationship between trustees and beneficiaries and propose potential problems which the legal specialist may need to resolve.
- Define the role of the legal specialist in the termination of trusts.
- Evaluate the effectiveness of various methods used in real estate planning as means to avoid probate.
- Design plans to minimize estate taxes.
- Analyze aspects of probate administration.
